With a final decision, the Supreme Administrative Court overturned the order of the Consumer Protection Commission (CPC) for the withdrawal from the market of the children’s bicycle Drag Kid Fit Rush 18.

The Court unequivocally ruled that the order issued by the CPC was unlawful due to significant violations of administrative procedural rules and the lack of a clear and specific legal basis for declaring the product as “dangerous goods.” The decision emphasizes that the application of standard BDS EN ISO 8098:2023 is voluntary, as it is not harmonized with Directive 2001/95/EC on general product safety and does not create an obligation for certification or testing.

The Supreme Administrative Court fully rejected the cassation appeal filed by the Chair of the CPC and confirmed that it was not duly proven that the children’s bicycle Drag Kid Fit Rush 18 poses a risk to the health and safety of consumers.
